Terms of Service — SentraMind

1. Acceptance of Terms

By accessing or using the SentraMind platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. If you do not agree, do not use the Service.

2. Description of Service

SentraMind provides an AI-powered security co-pilot for software development teams. The Service includes alert triage, code vulnerability scanning, and natural-language security queries (Chat-to-SOC). We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

3. Account Registration

You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You must be at least 18 years old to use the Service.

4. Acceptable Use

You agree not to use the Service to violate any applicable law, infringe on intellectual property rights, transmit malicious code, attempt to gain unauthorized access to any system, or use the Service for competitive intelligence gathering. We reserve the right to suspend accounts that violate these terms.

5. Subscriptions and Billing

Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We may change pricing with 30 days advance notice. If you cancel, your subscription remains active until the end of the current billing period.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by SentraMind and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of any code you upload for scanning; we do not claim ownership of your content.

7. Data Processing

We process your data in accordance with our Privacy Policy. By using the Service, you consent to such processing. For Enterprise customers with VPC deployments, data processing occurs within your specified infrastructure.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. While our AI provides security analysis, it should not be the sole basis for security decisions.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SENTRAMIND SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES. Our total liability shall not exceed the amount paid by you in the twelve months preceding the claim.

10. Termination

Either party may terminate this agreement at any time. Upon termination, your right to use the Service ceases immediately. We may retain your data as described in our Privacy Policy. Sections regarding liability, indemnification, and governing law survive termination.

11. Governing Law

These Terms are governed by the laws of Nepal, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Kathmandu, Nepal.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email or prominent notice on the Service at least 30 days before they take effect. Continued use after changes constitutes acceptance of the updated Terms.
